Customer Affidavit
- I am not currently less than twenty-one (21) years old
- By selling or delivering ammunition and/or firearms accessories to me, Bay’s Custom Cartridges is not violating any local, state or federal law concerning ordinance
- I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year
- I am not a fugitive from justice
- I am not an unlawful user or addicted to any controlled substance
- I have not been adjudicated as a mental defective and I have not been committed to any mental institution
- I am not an illegal or unlawful alien, and I am not a non-immigrant alien
- I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions
- I have not renounced my U.S. citizenship
- I am currently not subject to a domestic violence restraining order of any kind
- I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence
- I will not conduct an unauthorized export of any defense articles
Agreement to Indemnify and Defend for Misrepresentation
If any of the above statements under the “Customer Affidavit” section of these Terms and Conditions are untrue, you agree to release, hold harmless, indemnify, and pay to defend Bay’s Custom Cartridges and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.
Shipping
We do our best to ensure that your product reaches your door as quickly and as trouble-free as possible. During the checkout process, you will have the opportunity to select a shipping carrier (UPS or FedEx) and to designate the address to which you would like your products shipped. You cannot change this information after checkout.
Shipping Destination Restrictions
We do not ship outside the United States or any state that forbids ammunition from outside states, by Bay’s Custom Cartridges (South Carolina)
Order Cancellation by Customers
For your security, we cannot alter any product information or credit card charges after your order has been submitted. Please double-check your order an ensure integrity before submitting an order.
Order Cancellation by Bay’s Custom Cartridges
We do not like canceling orders, but we reserve the right to cancel your order if you do not abide by these Terms and Conditions. If we choose to cancel your order, you will receive a refund of the full purchase amount less a cancellation fee of $30.00 or 5% of the total purchase amount, whichever is greater.
Refusal to Accept Delivery
By placing an order with Bay’s Custom Cartridges, you agree to accept delivery of your order at the shipping address designated at checkout. If you fail to or refuse to accept delivery of your order, then you will forfeit the full purchase amount, including all taxes and shipping fees, and be charged for the cost of shipping the order back to our warehouse. It’s anticipated you placed the order, so accept the order and contact us after to minimize additional charges and wait times.
Release of Liability and Agreement to Indemnify and Defend
While Bay’s Custom Cartridges offers high-quality products, it is merely a retailer of products that are designed, manufactured, and tested by other companies. Therefore, you agree that Bay’s Custom Cartridges shall not be liable for any claims or damages, or for the breach of any warranty, express or implied, whether of merchantability or fitness for any purpose or otherwise, in any way related to any of the products listed on Bay’s Custom Cartridges official site.
Furthermore, you understand and acknowledge that Bay’s Custom Cartridges disclaims all liability for the accuracy of information provided to you, and for how you use information provided to you, by Bay’s Custom Cartridges. You understand and acknowledge that Bay’s Custom Cartridges cannot be held liable for how you or anyone else uses any information received from Bay’s Custom Cartridges.
Therefore, you agree to release, hold harmless, indemnify, and pay to defend Bay’s Custom Cartridges and its owners, agents, officers, and employees against any damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to your use of information provided by Bay’s Custom Cartridges. You further understand that manufacturers are the best resources for information about their products, including critical safety information. You must review all information and safety warnings from product manufacturers before purchasing and using products from Bay’s Custom Cartridges official site.
By placing an order with Bay’s Custom Cartridges, you agree that you alone are responsible for how the product is used by you or by any other party. You agree to release, hold harmless, indemnify, and pay to defend Bay’s Custom Cartridges and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution arising from or related to the products you purchase, including, but not limited to, the use, storage, or transportation of the product. If any other party files a claim of any kind against Bay’s Custom Cartridges arising out of or relating to your purchase, use, storage, or transportation of products from Bay’s Custom Cartridges official site, you will indemnify and pay to defend Bay’s Custom Cartridges and its owners, agents, officers, and employees against any resulting damages, including reasonable attorneys’ fees, civil liability, or criminal prosecution.
Jurisdiction
You agree that if you choose to file a lawsuit against Bay’s Custom Cartridges or any of its owners, agents, officers, or employees, that lawsuit must be filed in a court located in Aiken County, South Carolina. You agree that any lawsuit filed in any other jurisdiction shall be immediately removed to Aiken County, South Carolina and that you will reimburse Bay’s Custom Cartridges and its owners, agents, officers, and employees for any costs, including reasonable attorneys’ fees, they incur in defending a lawsuit or effecting its removal until the lawsuit is properly before a court in Aiken County, South Carolina
Governing Law
You agree that South Carolina law will govern (i) your purchase and use of any products from Bay’s Custom Cartridges; (ii) any information you receive from Bay’s Custom Cartridges official site; (iii) any legal action instituted against you by Bay’s Custom Cartridges; and (iv) any legal action you institute, or that someone else institutes as a result of your actions, against Bay’s Custom Cartridges.
Class Action Waiver
You agree that any dispute resolution proceedings, including litigation, arbitration, or mediation, between you and Bay’s Custom Cartridges will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of your right to bring any claims against Bay’s Custom Cartridges as part of, or on behalf of, any class or any other individuals.
